1. Acceptance of Terms

By accessing, browsing, or using the MyLocalBeautyPro website, mobile application, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

You must be at least eighteen (18) years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Platform Role

MyLocalBeautyPro operates solely as an online directory and marketplace that connects clients with independent beauty professionals ("Stylists"). The Platform serves as a venue for discovery and connection only.

MyLocalBeautyPro does not employ, supervise, or control any Stylists listed on the Platform.
MyLocalBeautyPro does not provide, perform, or deliver any beauty, cosmetic, or personal care services.
MyLocalBeautyPro does not guarantee the quality, safety, legality, or suitability of any services offered by Stylists.
MyLocalBeautyPro is not responsible for any interactions, communications, transactions, or disputes between users of the Platform.

3. Independent Contractors

All Stylists listed on MyLocalBeautyPro are independent contractors and are not employees, agents, joint venturers, or partners of MyLocalBeautyPro. Nothing in these Terms or on the Platform shall be construed to create an employment or agency relationship between MyLocalBeautyPro and any Stylist.

MyLocalBeautyPro does not control how, when, where, or whether Stylists provide their services.
Stylists are solely responsible for their own federal, state, and local taxes, including income tax and self-employment tax.
Stylists are solely responsible for maintaining all required professional licenses, permits, certifications, and insurance coverage as required by applicable law.
Stylists are solely responsible for compliance with all applicable laws, regulations, and professional standards governing their services.

4. User Responsibilities

For Clients:

Clients are solely responsible for independently verifying the credentials, qualifications, licenses, and insurance of any Stylist before engaging their services.
Clients are responsible for evaluating the skills, experience, and suitability of any Stylist, including reviewing any available ratings, reviews, or portfolio materials.
Clients assume all risk associated with engaging any Stylist found through the Platform.

For Stylists:

Stylists must provide accurate, truthful, and complete information in their profiles, including but not limited to their name, location, services, pricing, and qualifications.
Stylists must maintain all licenses, permits, and insurance required by applicable federal, state, and local laws to perform the services they offer.
Stylists must promptly update their profile information if any material changes occur.
Stylists must not engage in fraudulent, misleading, or deceptive practices on the Platform.

5. Identity Verification Disclaimer

MyLocalBeautyPro may collect a government-issued photo identification document from Stylists as part of the registration process. This verification is performed solely for the purpose of confirming the identity of the individual creating the profile.

MyLocalBeautyPro does not conduct criminal background checks on any user.
MyLocalBeautyPro does not verify professional licenses, certifications, credentials, or qualifications of any Stylist.
MyLocalBeautyPro does not verify the skills, training, experience, or competency of any Stylist.
Identity verification is limited to confirming that the individual matches the photo identification provided and should not be interpreted as an endorsement, recommendation, or guarantee of any kind.

6. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PRODUCTS AVAILABLE THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYLOCALBEAUTYPRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MyLocalBeautyPro does not warrant that Stylist profiles are accurate, complete, reliable, current, or error-free.
MyLocalBeautyPro does not warrant that the Platform will be available at all times, uninterrupted, secure, or free of errors or defects.
MyLocalBeautyPro does not warrant any particular results or outcomes from the use of the Platform or from engaging any Stylist.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYLOCALBEAUTYPRO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Damages arising from or related to any services provided by any Stylist found through the Platform.
Damages arising from disputes, disagreements, or interactions between users.
Loss of profits, revenue, data, business opportunities, or goodwill.
Personal injury, property damage, or any other damages resulting from services performed by a Stylist.

IN ANY EVENT, MYLOCALBEAUTYPRO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES, IF ANY, PAID BY YOU TO MYLOCALBEAUTYPRO DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless MyLocalBeautyPro, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

Your use of or conduct on the Platform.
Your violation of these Terms or any applicable law or regulation.
Any content or information you provide to or through the Platform.
Any services you provide or receive through connections made on the Platform.
Any dispute between you and another user of the Platform.

This indemnification obligation shall survive the termination of these Terms and your use of the Platform.

9. Content Ownership and License

You retain all ownership rights in the content you submit, post, or display on or through the Platform, including but not limited to profile information, photographs, portfolio images, reviews, and other materials ("User Content").

By submitting User Content to the Platform, you grant MyLocalBeautyPro a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and create derivative works of your User Content in connection with the operation and promotion of the Platform.

MyLocalBeautyPro reserves the right to remove, disable, or restrict access to any User Content that, in its sole discretion, violates these Terms, is objectionable, or may expose MyLocalBeautyPro to liability.

10. Account Termination

MyLocalBeautyPro reserves the right to suspend, deactivate, or permanently terminate your account and access to the Platform at any time, for any reason or no reason, with or without notice, at its sole discretion.

MyLocalBeautyPro may refuse service to any individual or entity at its sole discretion.
No refunds shall be issued for any fees paid in connection with terminated or suspended accounts, except as required by applicable law.
Upon termination, your right to use the Platform ceases immediately, and MyLocalBeautyPro may delete your account and all associated data.

11. Dispute Resolution

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be resolved through final and binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against MyLocalBeautyPro.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Venue: To the extent that any dispute is permitted to be brought in court, you agree that such dispute shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

MyLocalBeautyPro reserves the right to modify, amend, or update these Terms at any time and at its sole discretion. Any changes will be effective immediately upon posting of the revised Terms on the Platform. The "Last Updated" date at the top of these Terms will be revised accordingly.

Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree to the revised Terms, you must discontinue your use of the Platform immediately.
